15.1 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and NeuralWired agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, “Disputes”) will be resolved through binding individual arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
Arbitration will be conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator, not any court or agency, shall have exclusive authority to resolve all disputes, including but not limited to disputes about the interpretation, applicability, enforceability, or formation of these Terms, including any claim that all or part of these Terms are void or voidable.
15.2 Class Action Waiver
YOU AND NEURALWIRED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION.
Unless both you and NeuralWired agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of representative or class proceeding.
15.3 Opt-Out Right
You have the right to opt out of the arbitration and class action waiver provisions. To opt out, you must send a written notice to legal@neuralwired.com within 30 days of first accepting these Terms. Your notice must include your name, address, email address, and a clear statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms will continue to apply.
16. Severability and Waiver
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, shall constitute the entire agreement between you and NeuralWired concerning the Services.
